Terms of Use

These Terms govern access to and use of Pigskin' Pick'em and the pools organized through the service.

1. Acceptance of Terms

By creating an account, joining or creating a pool, making picks, using commissioner tools, or otherwise accessing Pigskin Pick'em (the "Service"), you agree to these Terms of Use and to any policies incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. If the law where you live requires a higher age or imposes additional restrictions on contests, pools, prizes, or similar activities, those requirements also apply to you.

3. Accounts

You are responsible for the accuracy of information associated with your account and for maintaining the confidentiality of your login credentials. You may not impersonate another person, create accounts for abusive or deceptive purposes, or knowingly permit unauthorized use of your account.

4. Nature of the Service

Pigskin Pick'em provides software for creating, administering, and participating in sports-prediction pools. The Service may provide schedules, game statuses, standings, scoring tools, communications, commissioner controls, notifications, and related organizational features.

Pigskin Pick'em is not a sportsbook, casino, bookmaker, wagering operator, escrow service, bank, money transmitter, or custodian of participant prize funds. Unless expressly stated otherwise in a separate written offering, Pigskin Pick'em does not accept wagers, collect pool entry fees on behalf of commissioners, hold prize funds, or distribute pool prizes.

5. Pool Terminology and Prize Language

The Service may use or permit users to use words such as "money," "cash," "entry fee," "buy-in," "paid," "payment," "pot," "jackpot," "winnings," "payout," "prize," or similar expressions. These are descriptive labels commonly used by pool organizers and participants and do not necessarily mean that legal tender, currency, monetary consideration, or a financial transaction is involved.

A pool may involve cash, gift cards, merchandise, meals, trophies, charitable donations, points, recognition, digital rewards, bragging rights, another lawful benefit, or no prize at all. A status such as "paid" or "unpaid" may simply be an organizer-defined tracking label.

The labels used in the Service do not determine the legal classification of an activity. The actual facts and applicable law control. Users must not rely on terminology within the Service to conclude that a pool, prize structure, or payment arrangement is lawful.

6. Commissioners

A commissioner is the user who creates or administers a pool. Commissioners are responsible for establishing and communicating their pool's rules, deciding whether any prize or participant contribution exists, handling participant questions, and operating the pool in accordance with applicable law.

The Service may allow commissioners to manage members, edit or correct picks where permitted, resolve unusual game outcomes, adjust standings, communicate with participants, or use other administrative tools. Participants acknowledge that these tools give commissioners meaningful control over their individual pools.

Pigskin Pick'em is not responsible for a commissioner's promises, prize arrangements, collection or distribution of funds, tax reporting, rule changes, exercise of commissioner tools, or disputes with participants.

7. Participant Responsibilities

Participants are responsible for reviewing pool rules, making picks before applicable deadlines, keeping account access secure, and determining whether their participation is lawful where they are located.

You may not exploit bugs, interfere with scoring or security, manipulate another participant's account, automate abusive traffic, scrape protected portions of the Service, or use the Service to facilitate unlawful conduct.

8. Picks, Deadlines, and Scoring

The Service may use scheduled kickoff times, game-data feeds, commissioner settings, and internal rules to determine when picks lock, when picks are revealed, and how results are scored. Third-party schedule or score information may be delayed, corrected, postponed, canceled, or otherwise changed.

We may correct platform errors, data-feed errors, duplicate records, or scoring defects when reasonably necessary to preserve the intended operation of the Service. Commissioners may also have authority to make pool-specific corrections using tools provided by the Service.

9. Prizes, Contributions, and Taxes

Unless Pigskin Pick'em expressly states otherwise in a separate written offering, any prize, participant contribution, reimbursement, or other transfer associated with a pool is arranged solely among the commissioner and participants and is outside the custody and control of Pigskin Pick'em.

Users are responsible for determining and satisfying any tax, reporting, licensing, registration, or other legal obligations arising from prizes, awards, payments, or participation.

10. Compliance With Law

Laws governing sports pools, contests, gambling, sweepstakes, lotteries, promotions, prizes, and payments vary by jurisdiction and may depend on facts such as consideration, chance, skill, prize value, location, and who receives an economic benefit. You are responsible for determining whether your use of the Service complies with all applicable laws and regulations.

Pigskin Pick'em does not provide legal, tax, accounting, or financial advice. A disclaimer or label inside the Service does not make otherwise unlawful conduct lawful.

11. Communications and Notifications

The Service may provide in-app notices, commissioner messages, email links or email delivery, reminders, and other communications. Delivery is not guaranteed. You remain responsible for monitoring deadlines and pool activity even if a notification is delayed or not received.

12. Third-Party Services and Data

The Service may rely on third-party hosting, authentication, email, game-data, database, analytics, or infrastructure providers. Pigskin Pick'em is not responsible for outages, inaccuracies, delays, policy changes, or failures caused by third parties beyond our reasonable control.

13. Intellectual Property

The Service, including its original software, design, text, branding, interfaces, and features, is owned by or licensed to Pigskin Pick'em and is protected by applicable intellectual property laws. These Terms do not transfer ownership of the Service to users.

14. Sports League and Team Disclaimer

Pigskin Pick'em is an independent service and is not affiliated with, endorsed by, sponsored by, or operated by the National Football League, any NFL club, or any other professional sports league or team unless expressly stated otherwise. Third-party names, marks, schedules, and other materials belong to their respective owners.

15. Suspension and Termination

We may suspend or terminate access when reasonably necessary to protect the Service or other users, investigate abuse or fraud, comply with law, enforce these Terms, or address security concerns. Users may stop using the Service at any time.

16. Service Availability

The Service is provided on an "as available" basis. We do not guarantee uninterrupted operation, perfect accuracy, or that all defects will be corrected immediately. Maintenance, outages, schedule changes, data-provider errors, network failures, and other events may affect availability.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, noninfringement, or uninterrupted availability.

18. Limitation of Liability

To the fullest extent permitted by law, Pigskin Pick'em and its owners, operators, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses arising from pool disputes, commissioner decisions, missed deadlines, data-feed errors, outages, lost profits, lost prizes, or unauthorized access not caused by our legally actionable misconduct.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

19. Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, and expenses arising from your unlawful use of the Service, your violation of these Terms, or a pool or prize arrangement you organize, except to the extent caused by Pigskin Pick'em own legally actionable conduct.

20. Changes to the Service or Terms

We may update the Service and these Terms from time to time. When a material change is made, we may provide notice through the Service or another reasonable method. The effective date shown above identifies the current version.

21. Severability and Entire Agreement

If a provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the extent permitted by law. These Terms and incorporated policies form the agreement governing use of the Service unless a separate written agreement applies.
